Terms & Conditions

These Terms & Conditions govern the use of MemoryBox, a product operated by Willfully Limited, founded by the Lasted Charitable Trust.

By creating an account or using MemoryBox, you agree to these Terms. If you do not agree, you must not use the service.

1. Who We Are

The Lasted Charitable Trust, run by its trustees, exists to support the long-term mission and continuity of the platform, including the preservation of stored memories.

References to “Lasted”, “we”, “us”, or “our” mean Willfully Limited.



2. Who Can Use MemoryBox

  • MemoryBox accounts are available to individuals aged 18 or over.

  • MemoryBox is intended for UK users. Users outside the UK may register at their own discretion.

  • These Terms are governed by the laws of England and Wales.

Accounts may be created by:

  • Individuals for themselves

  • Care home or hospice staff acting on behalf of a resident

  • Family members acting with appropriate consent

In all cases, the individual or resident remains the account holder.



3. What MemoryBox Is (and Is Not)

MemoryBox allows users to securely record and store personal memories, including video, audio, images, and written content, for private viewing or future sharing with nominated recipients.

MemoryBox:

  • Is a digital memory and legacy platform

  • Is not a medical service

  • Is not a will-writing or estate-planning service

  • Does not provide legal advice

Memories stored in MemoryBox do not form part of a legally binding will and do not replace professional legal advice.



4. Accounts and Access

  • You are responsible for keeping your login details secure.

  • You must ensure information you provide is accurate and up to date.

  • You must not allow unauthorised access to your account.

We may suspend, restrict, or terminate access where necessary to:

  • Protect users

  • Comply with the law

  • Enforce these Terms



5. Content Ownership

  • You retain full legal ownership of all content you upload to MemoryBox.

  • By using MemoryBox, you grant us a limited, non-exclusive licence to store, process, and deliver your content solely to operate the service.

Lasted does not claim ownership of your memories.



6. Privacy and Confidentiality

  • All MemoryBox content is private by default.

  • Content is not routinely accessed, viewed, or shared by Lasted.

Access may occur only where:

  • Required to resolve a technical or support issue

  • Required by law

  • Necessary to protect users or enforce these Terms

7. Posthumous Access and Release of Content

You may nominate recipients to receive access to your memories in the future.

Content is released only when a trigger is verified, which may include:

  • A trusted contact providing a unique access code, or

  • Submission of a death certificate or equivalent documentation

Until a trigger is verified:

  • Content remains private

  • No access is granted to others

If no trigger ever occurs, content remains private indefinitely.



8. Care Homes, Hospices, and Acting on Behalf of Others

Where staff assist a resident:

  • The resident remains the account holder

  • Appropriate consent must be in place

  • Staff do not gain ownership or independent rights over content

Lasted is not responsible for internal consent, safeguarding, or governance processes within care settings.



9. Acceptable Use

You must not upload, store, or share content that:

  • Is illegal or unlawful

  • Infringes the rights or privacy of others

  • Was recorded or uploaded without appropriate consent

  • Is abusive, threatening, or exploitative

  • Creates safeguarding concerns

  • Poses a risk to others or to the platform

You must not misuse the service, attempt unauthorised access, or interfere with the platform’s operation.



10. Content Moderation and Takedown

We reserve the right to:

  • Remove content

  • Restrict access

  • Suspend or terminate accounts

Where content:

  • Breaches these Terms

  • Raises safeguarding concerns

  • Exposes Lasted or others to legal or reputational risk

We will act proportionately and, where appropriate, notify the account holder.



11. Wills and Legal Services via Treadstone Law

Lasted and MemoryBox do not provide will-writing or legal services.

Where will-writing or related legal services are referenced or made available, these services are provided independently by Treadstone Law, a separate legal entity.

Engagement with Treadstone Law

  • Any will or legal document is entered into directly between you and Treadstone Law

  • Such services are governed by Treadstone Law’s own terms and privacy policies

  • Lasted does not draft, review, validate, or advise on wills or legal documents

Data sharing

Where you express interest in creating a will, you authorise Lasted to share limited personal data (such as your name and contact details) with Treadstone Law so they can contact you to progress the service.

Lasted accepts no responsibility or liability for:

  • The preparation, validity, or legal effect of any will

  • Advice or services provided by Treadstone Law



12. Free Service

MemoryBox is provided free of charge.

We reserve the right to introduce additional features or services in the future. There is no obligation to do so, and the core MemoryBox service remains free at present.



13. Availability and Continuity

We aim to provide a reliable service but do not guarantee uninterrupted availability.

If Lasted were ever to cease trading:

  • The Lasted Charitable Trust exists to support continued storage and preservation of content

  • Reasonable efforts would be made to allow users or their representatives to download or export content

We do not guarantee perpetual availability under all circumstances.




14. Account Deletion

  • You may request deletion of your account at any time.

  • A 7-day cooling-off period applies once deletion is initiated.

  • After this period, data is deleted within 7 days, in line with our Privacy Policy.


15. Liability

To the fullest extent permitted by law:

  • MemoryBox is provided “as is”

  • We are not liable for emotional distress arising from the creation or viewing of content

  • We are not responsible for the actions of nominated recipients or third parties

  • We are not responsible for content uploaded by users

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under English law.

17. Changes to These Terms

We may update these Terms from time to time. Updated versions will be published on our website with a revised date.

Continued use of MemoryBox constitutes acceptance of the updated Terms.



18. Governing Law

These Terms are governed by the laws of England and Wales.

Any disputes are subject to the exclusive jurisdiction of the courts of England and Wales.
